The Irish Examiner reports that a Kildare meat firm has begun a High Court action over a ministerial direction on rezoning in a local area plan.
The Minister for Housing, Planning and Local Government instructed Kildare County Councillors to reverse their decision, made in March 2016, to rezone 30 acres at Bodenstown, Sallins, for housing.
That land is owned by McCarthy Meats, of Clane.
The Irish Examiner notes that the Minister required Kildare councillors to revert to a provision in the 2009 local area plan in which a different 30 acres, also owned by the meat firm, was zoned for housing.
The firm contends the Minister was wrong, in law and in fact, in making the decision.
The case was adjourned to next week.
The High Court legal diary notes: "2016 830 JR MCCARTHY MEATS LIMITED -V- MINISTER FOR HOUSING PLANNING AND LOCAL & ANOR (Provisional) (4D)"
