It follows an incident in the county recently whereby a frustrated local cleaned up rubbish that was dumped illegally.
They found an address belonging to the culprit, however, Kildare County Council couldn't act, unless the person who found the address was willing to give a statement.
The local did not want to proceed, causing some complications.
It's understood that the council now has to contact the person who dumped the rubbish, "alleging" that they were behind it.
The culprit will also be required to explain how they dispose of their rubbish.
No fines were issued for illegal dumping across the county in 2023 and the council is not in a position to provide a breakdown of figures for last year.
